Shake - A promotional marketing tool for brands


How Contests Work:


Participation in "Contests": Users of Shake are permitted to join or create contests, wherein they may compete against others in predicting the outcomes of games, events, and similar activities. Contest results are determined by points accumulated, with rankings based on total points scored during the contest period. Contest participation is completely free for users.


Scoring System: Participants will receive one (1) point for each accurate prediction and zero (0) points for each incorrect prediction.


Contest Duration: The duration of contests may vary based on the specific contest parameters.


Types of Contests:

  1. Token-Based Contests: Participants can win in-app tokens by competing in these contests. Tokens earned may be utilized to enter brand reward contests. (Tokens can also be earned through other engagement-based activities on the Shake app. 

  2. Brand Reward Contests: Entry into these contests requires the use of previously earned tokens (which have no monetary value). Participants have the opportunity to win various rewards from partner brands, including but not limited to discounts, gift cards, and access to events and more.


No Financial Risk: Users are not required to spend money to participate in any contests. Participation in contests is free, and users are rewarded for their engagement within the app.


Shake operates as a promotional marketing tool for brands. The more engagement on the platform, the more valuable to our brand partners. 


The contests available through the Shake app are entirely organized, sponsored, and managed by Shake. Apple does not sponsor, affiliate with, or bear any responsibility for these contests. Participation does not require any purchase.


Shake does not offer any real-money gaming. The app is designed strictly for social entertainment and engagement purposes.

Shake's brand rewards feature is classified as promotional marketing, based on the structure of its contests, the absence of monetary risk for users, and the use of brand prizes to incentivize engagement. The following factors support this classification:


1. No Monetary Consideration:

  • No Consideration: There is no requirement for users to pay money or risk something valuable to enter.

  • Shake’s Structure: Shake does not require users to provide any monetary consideration to participate in its contests. Instead, users participate by making predictions about sports or entertainment events, and they earn points based on the accuracy of these predictions. Points and tokens used in the app are earned through engagement, such as making correct predictions or referring friends, and cannot be purchased.

  • In-App Tokens: Since tokens are earned entirely through user activity within the app, rather than purchased, the system avoids any monetary transactions, keeping it in compliance with promotional marketing guidelines.

  • Engagement-Based Rewards: Shake's reward structure is entirely based on user engagement. By completing actions like making predictions or referring friends, users earn points and tokens that can be used to enter higher-stakes contests.

3. No Element of Gambling:

  • Gambling Definition: Without the element of consideration, an activity cannot be classified as gambling.
